PURPOSE
These Terms and Conditions of Sale (hereinafter "T&C") govern the contractual relations between Auto Design (hereinafter "we" or "Auto Design") and any individual or legal entity wishing to make a purchase via the website www.auto-design.store ("the website") ("you" or "the customer"). By using the website and placing an order, you accept these T&C without reservation.
The present General Terms and Conditions apply to orders placed by customers worldwide and are governed by French law.
ARTICLE 1 – PURPOSE
These T&C define the rights and obligations of the parties in the context of the sale of products offered by Auto Design on the website.
ARTICLE 2 – PRODUCTS
The products offered for sale are those listed on the website, subject to availability. Auto Design reserves the right to modify the product assortment at any time. Each product is presented with a description of its main characteristics.
Certain products may be custom-made or personalized at the customer’s request. These products are subject to specific conditions, particularly regarding returns and refunds, as detailed in these T&C and in the Refund Policy.
ARTICLE 3 – PRICES
Product prices are indicated in U.S. dollars ($) or Euros (€), inclusive of applicable taxes, excluding shipping costs. Auto Design reserves the right to modify its prices at any time. The price applicable is the one displayed on the website at the time of the order.
ARTICLE 4 – ORDER
To place an order, the customer must follow the online ordering process and provide the required information. Any order placed implies full acceptance of these T&C. Auto Design confirms receipt of the order by email.
ARTICLE 5 – PAYMENT
Payment is made online via the payment methods available on the website. Orders are processed only after full payment has been received.
ARTICLE 6 – DELIVERY
Products are delivered to the address provided by the customer at the time of order.
Delivery times are provided for information purposes only. Auto Design cannot be held responsible for delays caused by carriers or circumstances beyond its control.
In the event that a parcel is not collected by the customer at a relay point within the time frame specified by the carrier, the parcel will be returned to Auto-Design. This does not constitute an order cancellation.
Any new shipment may result in repackaging fees and new shipping fees, at the customer’s expense, as detailed in the Refund Policy.
ARTICLE 7 – RIGHT OF WITHDRAWAL
In accordance with European consumer law, customers benefit from a legal right of withdrawal of fourteen (14) days from the date of receipt of the products, without having to provide a reason.
To exercise this right, the customer must notify Auto-Design by email within this period.
Returned products must be unused, in perfect condition, and in their original packaging.
This right of withdrawal does not apply to personalized or custom-made products, in accordance with applicable law.
Return shipping costs remain the responsibility of the customer.
Refunds are processed in accordance with the conditions set out in the Refund Policy.
ARTICLE 8 – WARRANTIES
All products sold on the website benefit from the legal guarantee of conformity and the warranty against hidden defects, in accordance with applicable law.
Any damage occurring during transport must be reported in accordance with the conditions and time limits specified in the Refund Policy.
ARTICLE 9 – LIABILITY
Auto Design cannot be held liable for non-performance of the contract in the event of force majeure, carrier disruption, strike, natural disaster, or any event beyond its control.
Auto Design shall not be liable for indirect damages, including loss of profit, loss of opportunity, or commercial loss.
ARTICLE 10 – INTELLECTUAL PROPERTY
All elements of the website are protected by intellectual property laws and remain the exclusive property of Auto Design. Any unauthorized use may result in legal action.
ARTICLE 11 – PERSONAL DATA
Auto Design processes personal data in accordance with applicable data protection laws. Customers may exercise their rights in accordance with the Privacy Policy available on the website.
ARTICLE 12 – DISPUTES AND APPLICABLE LAW
These T&C are governed by and construed in accordance with the laws of France.
In the event of a dispute, an amicable solution will be sought prior to any legal action. Failing this, the competent courts of France shall have exclusive jurisdiction.
ARTICLE 13 – MODIFICATIONS TO THE T&C
Auto Design reserves the right to modify these T&C at any time. The applicable version is the one in force on the date the order is placed.
